OnePlus has sought three months time to clear its stock and develop a new OS that will replace Cyanogen.
Shenzhen OnePlus Technology Co. Ltd has told the Delhi High Court that the operating system being offered on its OnePlus One phone is different a version of Cyanogen from the one Micromax had secured an exclusive licence from Cyanogen.
OnePlus added that its phones featured CM11S version of the Cyanogen software while Micromax offered a different version. The company also the agreement between Micromax and Cyanogen implied that Cyanogen cannot collaborate with other smartphone makers in the country.
The company also sought three months of time to clear its stock as well as come up with a new software to replace Cyanogen. According to reports, the court observed that Cyanogen wasn't fair with OnePlus and Micromax.
The latest development comes after OnePlus was temporarily banned from marketing, selling and shipping of its smartphones in India. The directive came after Micromax sought an injunction against OnePlus for allegedly infringing upon exclusive rights it had acquired with Cyanogen. Micromax recently launched its Cyanogen based Yu Yureka smartphone in India.
OnePlus- Micromax-Cyanogen tussle comes amid Xiaomi and Ericsson entered in a legal battle over patent issues. Ericsson claimed the Chinese company had infringing upon its patent.
